Asbestos is a mineral that was widely used in home construction between 1945 and 1994. Asbestos cement is fire-resistant, insulating, and inexpensive. When asbestos becomes loose or damaged, it poses a significant risk to lung health. Asbestos fibers can be released, particularly during demolition or renovation work. A certified company will carefully inspect your home to determine the location and quantity of asbestos.

Is the home seller obliged to report asbestos?

The seller is obligated to report asbestos to the buyer. If the seller fails to do so, the buyer can hold them accountable (hidden defect). However, the seller is not obligated to remove asbestos. The buyer can make agreements with the seller about this, such as purchasing the property on the condition that the asbestos is removed.
However, reporting the asbestos from the buyer's perspective doesn't always provide sufficient clarity. For example, the buyer isn't obligated to report the exact location of the asbestos, its quantity, or the type. These are precisely the things that are important to know.

Reasons for an asbestos inspection

Asbestos poses a significant health risk when damaged or dislodged. This can occur during demolition or renovation work. Therefore, it's crucial to know where the asbestos is located. Other important factors examined during an asbestos inspection include the amount of asbestos present, the type of asbestos, and the costs involved in removing it. It's even mandatory to have an asbestos inventory performed before demolishing or renovating homes built before 1994!
